The mission of Multiversity of Success is to improve the lives of people in society and help them move towards an all-around successful life.

Multiversity of Success; referred to as MS in later parts of this document; is committed to doing the following activities:

1: To enable anyone anywhere to create & conduct online personal development, professional as well as educational courses using the online platform provided by MS.

2: To allow anyone anywhere to enroll in these courses to learn them online,

3: To enable anyone anywhere to provide any life online betterment services to help humanity.

4: To enable anyone anywhere to receive such life betterment online services online,

5: To enable anyone anywhere to sell any life betterment products legally permitted to be sold through online selling platform

6: To enable anyone anywhere to buy such products; through the platform provided by MS.

MS considers this platform as the best possible way to offer valuable success education, both academic and professional, other life success related to trainings, life betterment services and goods to the users.

MS needs rules to keep this platform & its services safe for all users, for the MS itself, for the students & trainer community, for the service receiver & service provider community and for the buyer and vendor community.

These Terms apply to all activities done by all users, on the entire MS website, all the MS mobile applications, all the MS TV applications, all the MS APIs and other related services.

To whom the terms & conditions apply:

1: Students, who take a course on the MS (Multiversity of Success) platform, must agree to the students’ Terms.

2: Trainers, who publish a course on the MS (Multiversity of Success) platform, must agree to the Instructor Terms.

3: Service receiver, who receives online service through Multiversity of Success platform, must agree to the service receivers’ Terms.

4: Service providers, who provide online service through Multiversity of Success platform, must agree to the service providers’ Terms.

5: Buyers, who buy any product through on the MS (Multiversity of Success) platform, must agree to the buyers’ Terms.

6: Vendors, who sell any product through on the MS (Multiversity of Success) platform, must agree to the vendors’ Terms.

Let us see these points in details:

1. Account:

Every user other than the one who is doing just a simple search, needs to create an account on our platform for carrying out any activity he/she wants; by filling up all required details for all activities.

1.1    Password

Every user creating an account on this platform must keep one’s own password safe, as the user is totally responsible for all the activity associated with his/her account.

In case if any user suspects that someone else is using his/her account, such a user must immediately inform MS about the same by contacting its Support Team on support@multiversityofsuccess.in.

1.2    Age of consent

Any user must have reached the age of consent for online services in his/her country to use Multiversity of Success site.

1.3    Information

When setting up and maintaining any account, the user must provide and continue to provide accurate and complete information, including a valid name, phone number, address and email address.

1.4    Responsibility

The user has a complete responsibility for his/her account and everything that happens on his/her account including for any harm or damage caused by the activity on such account to MS or anyone else; even when such harm is caused by someone using the user account without his/her permission.

This means every user needs to be careful with his/her password.

No user must ever transfer his/her account to someone else.

No user must ever use someone else’s account.

If any user contacts MS to request access to any account, other than the account of the user himself/herself, MS will not grant him/her such access. Even when any user asks MS to request access to his/her own account, MS will not grant it unless he/she can provide MS with all the information that MS needs to prove it beyond doubt that such a person is actually the legitimate owner of that account.

1.5    Death of user

When any user dies, his/her account will be closed, when MS receives the notification of such a demise of that user. So, in the event of the death of a user, the account of that user will be closed.

1.6    Sharing account details

No user must share his/her account login credentials with anyone else. In case if one does so, such a user is solely responsible for what happens with his/her account and Multiversity of Success will not intervene in any way whatsoever, in disputes arising out of such action.

1.7    Suspicion of hacking

In case if any user suspects that someone else is using his/her account, it is the responsibility of such a user to notify such a fact immediately to MS about the suspicion that someone else may be using his/her account without his/her permission.

The user must also do the same if the user suspects any other breach of security about his or her account.

The user must do so by contacting our Support Team at support@multiversityofsuccess.in.

MS may request some information from such a sender to confirm that the sender of such a mail is the lawful owner of that account, and then may help the user to change his/her security.

1.8    Age for opening account

Students and instructors must be at least 18 years of age to create an account on MS and use the Services.

1.9    Opening account for minor student

If the student, service receiver or buyer is younger than 18 but above the required age for consent to use online services where such person lives, such person may not set up an account by himself or herself but can invite a parent or guardian to open an account and help him/her enroll in courses that are appropriate for you. If the actual user is below this age of consent to use online services, such a user cannot create an MS account. If MS discovers that anyone has created an account that violates these rules, MS can immediately terminate such an account.

1.10  Identity details of instructor/service provider/vendor

Every Trainer, Service provider as well as a vendor needs to conclusively verify his/her identity with all required details and agree on the terms and conditions laid down for them before such a person is authorized to submit a course, service or product for publication on MS.

1.11  Termination of account

Any user can terminate his/her account at any time by following the steps given on the site to terminate the account. Check the Privacy Policy of MS to see what happens when one terminates one’s own user account.

2. Course Enrollment and Access:

Here are the terms and conditions for joining and attending the online courses:

2.1    Access to the online live course:

When a student enrolls in a course by paying the course fee,  he/she gets a link from the course page and he/she can attend the same on the said date and time; via the link provided via that course page.

2.2    Permission to attend all lessons in the course

Some courses are single session ones and some are ongoing. So, when a student registers for a course that has many sessions, he/she can attend all the zoom course sessions for the course that the student has enrolled for, on the said dates at the said times on the said link.

2.1    Responsibility for missed sessions

But in case a student misses any session due to any such reason for which the trainer or MS is not responsible, the student is solely responsible for the loss and the instructor or MS is in no way liable for any compensation, reimbursement or return of fees for any such loss. In such case, whether or not to allow such a student in any further session to compensate for this, will solely be the discretion of the trainer, who may allow such a student in any other class to compensate the lost session with due permission from MS authorities.

2.2    Non-disclosure of personal details agreement

The student must agree not to disclose or ask for any personal details like one’s phone number, mail id or residence address etc. at any point during the course of training to trainer or co-students. In case if it is noticed that any student is doing so, the id of such student will be blocked with an immediate effect, he will not be allowed to continue with any course after such behavior. In such a case, the student will be losing the fees he has already paid.

When any trainer publishes a course on the platform of MS, they grant MS permission to grant access of the zoom meeting conducted to teach that course to students. This means that MS has the right to sublicense the course to the students who enroll in the course.

As a student, when one registers and enrolls in a course, whether it’s a free or paid course, a student gets a link from MS to attend the online course via the MS platform, and MS is the licensor of such a course. MS will record each course meeting and preserve it for reference to keep a track of what trainers and students are doing during the course.

This permission does not give any right to any student or trainer to record a course and resell it in any manner, including by sharing account information with another person who may be a purchaser or illegally downloading course recording & sharing it on torrent or similar sites.

In legal, more complete terms, MS grants a student, a limited, non-exclusive, non-transferable license to attend the online lessons of the course and access the associated content for which a student has paid all required fees, solely for his/her personal, non-commercial, educational purposes through the MS platform, in accordance with these Terms and any conditions or restrictions associated with a particular course or feature of MS services. All other uses are expressly prohibited. No student can reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course material unless MS gives any explicit permission regarding the same in a written agreement signed by an MS authorized representative. This also applies to content any user can access via any of our APIs.

MS gives access to any students for the specific course for the specific date or tenure for which they enroll in a course. However, MS reserves the right to revoke any permission to such access and permission to attend the online courses at any point in time in the event where MS has to decide or is obligated to disable access to a course due to legal or policy reasons or due to the misbehavior of any student or due to the violation of terms by any student.

As long as the student has completed any course, he has lifetime access to add-on features and study materials associated with a course when a student is not allowed to download the study materials. His means, a student can have lifetime access is to the course content but not to the live course sessions and to the trainer.

3. Pricing and payments

When anyone makes a payment, one agrees to use a valid payment method. If one is not happy with any course on this platform, such a person is free to contact MS with valid reasons for such dissatisfaction. In such cases, the refund policy stated in point 9 of this document will apply.

3.1    Pricing:

The prices of courses on MS are determined by the Instructor and the instructors can choose to provide any discounts for their course promotions as and when they choose. MS has absolutely no say in the pricing or promotions declared by the trainers. The trainers are free to keep different prices for the same course for different countries if they so wish. In other cases, the price that is chosen by the trainer is automatically converted into other currencies as per current exchange rates.

We do not enable users to see pricing in different currencies. The currency of transaction used by Multiversity of Success at this moment is just INR, and all payments paid here may be transferred to INR and paid.

3.2 Payments:

The users agree to pay the fees for courses that they purchase, and authorize MS to charge their debit or credit card or process other means of payments, such as Gpay, Paytm, direct debit, or mobile wallet etc. for those fees. MS works with third-party payment processing partners to offer the most convenient payment methods in any country and to keep the payment information secure.

When anyone enrolls for any online workshop, one agrees not to use an invalid or unauthorized payment method. If the payment method fails and the user still gets access to the course, the user is bound to pay the corresponding fees at least prior to completion of the first session of such a course. If the student fails to make such payment, MS may disable access to the course for which MS has not received adequate payment.

3.3 Refund policy and Refunds:

All the refunds will be subject to the refund policy of Multiversity of success. The students, service receivers or buyers can choose to ask for a refund of the fees or amount they have paid in certain situations. The policy about this is given in detail in point 9 of this document.

3.4 Gift and Promotional Codes:

MS or our partners may offer gift and promotional codes to students. Certain codes may be redeemed for gift or promotional credits applied to your MS account, which then may be used to purchase eligible courses on our platform, subject to the terms included with your codes. Other codes may be directly redeemable for specific courses. Gift and promotional credits can’t be used for purchases in our mobile or TV applications.

These codes and credits, as well as any promotional value linked to them, may expire if not used within the period specified in your MS account. Gift and promotional codes offered by MS may not be refunded for cash, unless otherwise specified in the terms included with your codes or as required by applicable law. Gift and promotional codes offered by a partner are subject to that partner’s refund policies. If you have multiple saved credit amounts, MS may determine which of your credits to apply to your purchase. Check out our Support Page and any terms included with your codes for more details.

4. Remunerations & payouts

The payment share of the fees and remuneration share of the sold goods that the trainers, service providers and vendors will receive for their services will be as follows:

4.1    Remuneration to trainers

The trainers who announce the training courses here and conduct them successfully with no breach of rules for trainers, with no complaints from any student and with no refund requests, will be given the decided percentage of fees as remuneration within 60 days of completion of the training course. This amount will be credited to the bank account provided by the trainer in his/her account as a trainer.

The percentage of fees that the trainer will get depends on his/her trainer type as regular/premium/VIP. These percentages will be intimated to the trainer in the approval form of the trainer has to choose his/her trainer type and submit after his credentials are verified and his role as a trainer is approved by our verification team.

4.2    Remuneration to service providers

The service providers who provide any service successfully with no breach of rules for trainers, with no complaints from service receiver and with no refund requests, will be given the decided percentage of fees as remuneration within 60 days of completion of the training course. This amount will be credited to the bank account provided by the service provider in his/her account as a service provider.

The percentage of fees that the service provider will get depends on his/her service provider type as regular/premium/VIP. These percentages will be intimated to the service provider in the approval form of the service provider has to choose his/her service provider type and submit after his credentials are verified and his role as a service provider is approved by our verification team.

4.3    Payment to vendors

The vendors who sell their products here successfully with no breach of rules for vendors, with no complaints from any buyer and with no returns and/or refund requests, will be given the decided percentage of fees as remuneration within 60 days of completion of the deal. This amount will be credited to the bank account provided by the vendor in his/her account as a trainer.

This percentage will be intimated to the vendor in the approval form of the vendor after his credentials are verified and his role as a vendor is approved by our verification team.

5. Content and Behavior Rules:

The trainers, service providers as well as vendors can use only MS for lawful purposes.

5.1 Content:

All trainers are responsible for all content that they teach or post using our platform. They must also keep the reviews, questions, posts, courses and other content they upload in line with our Trust & Safety Guidelines & law, and respect the intellectual property rights of others.

5.2    Our right to ban:

MS will be intimating the trainer, service provider or vendor for the first breach of rules and ask the person to correct the mistake. But MS reserves the right to ban any trainer, service provider or vendor account for repeated or major offenses.

5.3    MS liability & action on trainer’s infringement of IP rights:

If any person, thinks that some trainer, service provider or vendor is infringing his/her copyright on our platform, let us know. In such a case, the trainer, service provider or vendor who is alleged of such infringement will be solely responsible for any such action taken by the person whose IP rights are infringed and will be liable to pay any lawful penalty charged by the aggrieved party.

5.4    Lawfulness of the purpose of use:

No trainer is ever permitted to access or use the Services or create an account for unlawful purposes. The use of the Services and behavior of every trainer, service provider and vendor on our platform must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.

5.5    Limitation to access of our services:

You may not access our Services if you are from a territory where Indian businesses are prohibited from engaging in business or if you have been designated a Specially Designated National, Denied Person, or Denied Entity by the Indian government. Further, you agree not to upload any content or technology (including information on encryption) whose export is specially controlled under the Export Administration Regulations or other applicable regulations.

5.6    Asking questions to the trainer:

A student has the right to ask questions related to the course material contents to the instructors of courses he/she is enrolled in, during the process when the course is in progress and within a period of 30 days after the course is concluded and to post reviews of courses.

5.7    Tests and exams conducted by the trainer:

The trainer has every right to give some project work as “homework” or to conduct tests at the end of every lesson and/or at the end of the total course training. The students will be required to submit the projects or answer the test questions in the required format before they are declared to have successfully completed the course they pursue.

5.8    Responsibility of trainers towards projects and tests

Every trainer must submit the tests in the MCQ pattern with choices and answers; where every student will be receiving a separate question paper by the random selection method. For each question number, the trainer has to submit a minimum of 5 and a maximum of 10 questions of which anyone can appear in the question paper the student gets.

A test after a single lesson may contain 5 to 10 questions and the test after completion of the whole curriculum may contain 25 to 100 questions. The actual number of questions within the given limits will solely depend on the discretion of the trainer.

5.9    Responsibility of trainer towards curriculum & lessons

Every trainer must submit course curriculum, lesson titles and study material files for the course material for publication on the platform. But as the trainer is doing so, as far as possible, the trainer must post original self-created material and if the trainer has used the material created by someone else, he must do so with due permissions. This means the trainer must never infringe or violate the lawful rights on the study material of any such person who has originally created such material. In case if a trainer is found violating such rights, he will be solely responsible for the consequences. MS is in no way liable for any such violation by the trainer.

5.10  Rights and restrictions of trainer-student communication

The trainers can communicate with the students who have enrolled in their courses on our chat platform. In both cases, both students and trainers must abide by the law and respect the rights of others; students cannot post any unrelated question nor can the trainer provide or seek any unrelated personal information.

5.11  Posting of courses, content or questions

A trainer cannot post any course, question, answer, review or other content that violates applicable local or national laws or regulations of the country of residence of the trainer as well as of India. Every trainer is solely responsible for any courses, content, and actions the trainer posts or takes via this platform and services and their consequences. So, every trainer MUST make sure that he/she understands all the copyright restrictions set forth in the copyright laws of India as well as the country of residence of the trainer and of the country of origin of the author from whose writing the trainer is using the material before the trainer submits any course for publication on MS.

5.12 Violation of copyright etc. by trainer or others

If MS is brought to the notice that any course or content violates the law or the rights of others, and /or if it is established beyond doubt that the course content used by any trainer violates the intellectual property or image rights of others, or is about some illegal activity, Or if MS discovers that any content by any trainer/vendor violates the Trust & Safety Guidelines, or if MS believes the content or behavior of any trainer, service provider or vendor unlawful, inappropriate, or objectionable, or if any trainer, service provider or vendor appears to or is proven to impersonate someone else; MS has right to remove such content from our platform and debar the trainer, service provider or vendor from doing any further business with us, by deactivating the account of such trainer, service provider or vendor with immediate effect. MS complies with copyright laws. Check out our Intellectual Property Policy for more details.

5.13 Right of MS to terminate or suspend an account

MS has discretion in enforcing these Terms and our Trust & Safety Guidelines. MS may terminate or suspend permission to use our platform and Services or ban an account at any time, with or without notice, for any or no reason, including for any violation of these Terms, if anyone fails to pay any fees when due, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems, or if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination we may delete your account and content, and we may prevent you from further access to the platforms and use of our Services. Your content may still be available on the platforms even if your account is terminated or suspended. You agree that we will have no liability to you or any third party for termination of your account, removal of your content, or blocking of your access to our platforms and services.

If any of our trainer, service provider or vendor has published a course or content or puts any product for sale, that infringes the copyright or trademark rights, of anyone else, the people at large are free to let us know about the same. Our trainers, service providers as well as vendors require to follow the law & to respect the intellectual property rights of others. If such a claim is found to be valid, MS has the right to suspend or terminate the account of a member who has made such a violation of the rights of others.

6. Rights of MS to content that trainers/students Post:

The policy about content that the trainer’s post is as follows:

6.1    The trainer has all rights & liabilities towards his content

The trainer retains the ownership of content he/she posts to the platform of MS, including course content and course study materials. This means the trainer will be responsible and have all the rights as well as liabilities about the ownership as well as the use of the content. Multiversity of Success has no role to play in the title or user rights of any such content. Multiversity of Success is just providing a platform to the trainer.

6.2    MS has all the rights to share such content through media etc.

By placing such content on the platform, the trainer is deemed to agree that he has allowed MS to share such content to anyone through any media, including promoting it via advertising on other websites.

6.3    Right of MS on blog posts and other posted content

The content anyone posts as a student or instructor including the study material of the courses as well as blog posts; continues to be owned by the writer of the content and the writer of such content will continue to enjoy all its benefits and take all the liabilities of such content.

By posting courses and other content, the trainers and others allow MS to reuse and share it but the creators of the content do not lose any ownership rights they have over such content.

When anyone posts content, comments, questions, reviews, and when they submit ideas and suggestions to us for adding new features or for making improvements in the site, they authorize MS to use and share that content about suggestions and ideas with anyone, distribute it and promote it on any platform and in any media, and to make modifications or edits to it as MS finds appropriate.

This means, by submitting or posting content on or through the platforms, the content creator and/or content posting person grants Multiversity of Success a worldwide, non-exclusive, royalty-free license; with right to sublicense; to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your content; including the name and image of content creator, in any and all media or distribution methods existing now or will be later developed. This includes making such content available to other companies, organizations, or individuals who partner with MS for the syndication, broadcast, distribution, or publication of content on other media, as well as using your content for marketing purposes. The content creators also waive any rights of privacy, publicity, or other rights of a similar nature applicable to all these uses, to the extent permissible under applicable law. These content creators represent and warrant that they have all the rights, power, and authority necessary to authorize us to use any content that you submit. They also agree to all such uses of their content with no compensation paid to them.

7. Choosing the total responsibility of Using MS:

Anyone can use MS to create and publish courses and train any subject of any modality online; using the platform created and promoted by MS. MS enables the trainers and students to interact over this platform for teaching and learning. MS enables service providers to interact with service receivers over this platform and provide online services. MS also enables the vendors to post their products in MS shop and sell them.

MS also enables the members of all these categories to post their comments and views etc. in the blog posts of MS. But, like other platforms where people can post content and interact, in case if some things go wrong, all users must agree use MS at their own risk.

The authorities that run Multiversity of success do not necessarily review or edit the courses created by the trainers for legal issues, and do not own any responsibility to determine the legality of course content.

MS does not exercise any editorial control over the courses that are taught and course contents that are available on the platform and, as such, do not guarantee in any manner the reliability, validity, accuracy, or truthfulness of the courses. This means, if any student enrolls in any course posted by any trainer, they automatically agree to rely on all the information provided by their trainers at their own risk.

By using the Services, the students may be exposed to content that some people may consider offensive, indecent, or objectionable. MS has no responsibility to keep such content away from the students and holds no liability for any such access or enrollment in any course, to the extent permissible under applicable law. This also applies to courses relating to health, wellness, and physical exercise. The seekers are supposed to have agreed and consented to acknowledge the inherent risks and dangers in the strenuous nature of these types of courses, and by enrolling in such courses they are assumed to have given consent to choose to assume those risks voluntarily, including risk of illness, bodily injury, disability, or death. This means, the seekers assume full responsibility for the choices they make before, during, and after their enrollment in any course.

When anyone interacts directly with a student or trainer, a service provider or service receiver, vendor or buyer, one must be careful about the types of personal information that one shares. While MS restricts the types of information trainers may request from students and vice-versa, MS does not control what students and trainers do with the information they obtain from other users on the platform. Also, MS has categorically stated that during the course of any training, neither the trainer nor the student must share email or other personal information.

MS does not hire or employ any trainers, service providers or vendors nor is MS in any way whatsoever responsible or liable for any interactions involved between trainers and students, service providers and service receivers or vendors and buyers. This means MS is not liable for disputes, claims, losses, injuries, or damage of any kind that might arise out of or related to the conduct of trainers, service providers, vendors, students, service receivers or buyers.

When anyone uses the services provided by MS, they may even find links to other websites that MS doesn’t own or control. MS is not responsible for the content or any other aspect of these third-party sites, including their collection of information about visitor. Those who visit any such sites must read the terms, conditions & privacy policies of such sites before they enter any of their personal information. MS is in no way responsible for what happens to such information in given to other sites.

8. Rights of Multiversity of Success:

The Multiversity of Success owners own the MS platform and services, including the website, present or future apps and services, and things like MS logos, API, code, and content created by the employees of Multiversity of Success. So, no third party has any right and authority to tamper with these things or use them without lawful authorization by MS.

All right, title, and interest in and to the MS platform and Services, including MS website, the existing or future applications by Multiversity of Success, MS APIs, databases, and the content our employees or partners submit or provide through MS services; but excluding content provided by trainers, service providers, vendors, students and other users; are and will remain the exclusive property of MS and its licensors. The MS platforms and services are protected by copyright, trademark, and other laws of both the Indian States and foreign countries. Nothing gives anyone else any right whatsoever to use the name “Multiversity of Success” or any of the MS trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions the viewers or users may provide regarding the structure, function or services of MS is entirely voluntary and MS is free to use any such feedback, comments, or suggestions as it finds fit and without any obligation to the person giving such comment, suggestion or feedback.

8.1    Actions not permitted while using MS platform and services

No one else has any right to do any of the following while accessing or using the MS platform and services;

1. Access, tamper with, or use non-public areas of the platform (including content storage), MS computer systems, or the technical delivery systems of MS service providers.
2. Disable, interfere with, or try to circumvent any of the features of the platforms related to security or probe, scan, or test the vulnerability of any of our systems.
3. Copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the MS platform or Services.
4. Access or search or attempt to access or search our platform by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our website, mobile apps, or API (and only pursuant to those API terms and conditions). You may not scrape, spider, use a robot, or use other automated means of any kind to access the Services.
5. In any way use the services to send altered, deceptive, or false source-identifying information like sending email communications falsely appearing as MS; or interfere with, or disrupt, or attempt to do so, the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on the Service.

8.2    Right of MS to legal action against one doing any above act

If any user or person is found doing any of the above things, MS has all the rights to take legal action on such a person and claim the damages for the action such a person does.

9. Return and refund policy

The students, service receivers and buyers can claim refund of their paid amount and return goods they purchased under the following policy:

9.1    Refunds to students

If the student has completed the course and after that if he files any claim, whether to entertain any such claim or not will be solely the discretion of the Multiversity of Success authorities.

The claims can be considered for courses that are yet to commence as well as ongoing courses.

In case of courses that are yet to commence, if the student files a claim of cancellation of his registration, he gets all his fees back after deducting the GST and other taxes that Multiversity of Success might have actually and already paid for that transaction.

In case of ongoing courses, the refund policy will be as follows:

1. If due to any reason, the online course declared by the trainer is cancelled the students who have registered for and paid for the same, will be refunded all fees they have paid without any deduction, within 15 days of such a cancellation.
2. If student reports to us after less than 1/5^th of the course lessons are over, he/she can have a choice to opt out of it and claim a total refund of the fees paid, without further enquiry.
3. If student reports to us after less than 1/3^rd of the course lessons are over, he/she can have a choice to opt out of it and claim 40% refund of the fees paid without further enquiry or 70% of the fees if the complaint by that student is found genuine after verification of course recording by our team but no refund and yet removal from the class if the complaint is found to be false or fake.
4. If a student reports to us after less than 2/3^rd of the course lessons are over, he/she can have a choice to opt out of it and claim 20% refund of the fees he/she has paid without further enquiry or 50% of the fees if the complaint by that student is found genuine after verification of course recording by our team but no refund and yet removal from the class if the complaint is found to be false or fake.
5. If a student reports to us after more than 2/3^rd of the course lessons are over but more than 1/5 are still remaining, he/she can have a choice to opt out of it but in such a case he can claim a refund of 10% of the fees and will be removed from further course, so will not get any certificate or recognition.

9.2    Refunds to service receivers

When a service receiver takes the online service, such a person can ask for refund of the fees if and only if; a service provider who has given such online service to this person; has categorically made some claim about what the service receiver will get after availing the said service and if such a claim is not fulfilled within the stipulated period.

In such a case, the service receiver has to prove it to Multiversity of Success that the service provider had made any such claim and that the claim is not fulfilled within the period guaranteed by the service provider.

Also, in order to claim any such refund, the service receiver must apply for such a refund within 10 days after such a period required for seeing the results is over. Yet, such a refund is possible only and only if the service receiver has paid Multiversity of Success in order to receive said service from provider, then Multiversity of Success will be refunding the amount such a service receiver has paid to Multiversity of success for such a service if the claim is found genuine after verification of all the facts by our team; but if such a complaint is found to be fraudulent, false, deliberately defamatory or fake no refund will be granted and also such filing of false fraudulent claim may also amount to the cancellation and blocking of service receiver’s account in addition to defamation charges.

Even if the service receiver has contacted the service provider after getting the contact from Multiversity of success, but has made the payment for such a service directly to the service provider, Multiversity of Success is in no way responsible for any type of refund and will not entertain any such refund claim.

9.3    Return of goods by buyers

If any goods purchased by a buyer is not found up to the mark, or dissatisfactory or purchased by mistake or sent to a wrong address, the buyer can certainly return such goods when they are returnable.

But in such a case, the buyer will need to bare the courier charges for such goods back to the vendor.

9.4    Refunds to buyers

This means, the transportation amount will be deducted from the cost of the product and remaining amount can be refunded to the buyer after the product is received back.

But if it is noticed that the product was damaged not during the transport, but due to the wrong handling of the buyer, he will not be liable to receive any refund.

When the buyer is found to deserve his refund, after receiving the goods back, the amount minus transport charges is credited back to the account of the buyer within 10 working days.

10. Miscellaneous Legal Terms:

These Terms are like any other contract, and they have boring but important legal terms that protect everyone from consequences that could happen in absence of such knowledge. They also clarify the legal relationship between MS and others.

10.1 Binding Agreement:

The member agrees that by registering, accessing, or using the Services of MS, they are agreeing to enter into a legally binding contract with MS. Those who do not agree to these Terms, need not register, access, or otherwise use any of the services of MS.

Every user, who is a trainer, service provider or vendor, who is using this platform, is deemed to be authorized to do so once any such user has started using this platform after accepting these terms.

Also, if any user wishes to have a version of these Terms in a language other than English, he may so communicate and the translation will be provided duly to such a person for convenience and once such a person agrees such a translation, it will be taken that such a person has accepted, understood and agreed that the English language will control the entire communication with MS if there is any conflict.

These terms including any agreements and policies linked from these Terms; constitute the entire agreement between any user and Multiversity of Success and include, the trainers’ Terms, service providers’ terms, vendors’ terms, terms for students, service receivers and buyers and also covers the Promotions Policy used by Multiversity of Success; irrespective of the fact whether these policies are stated separately or are just included in this entire statement of term.

If any part of these Terms is found to be invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect.

Even if MS is delayed in exercising its rights or fail to exercise a right in any case, it doesn’t mean MS waives its rights under these Terms, and MS may decide to enforce them in the future. If MS decides to waive any of its rights in a particular instance, it doesn’t mean they are to waive their rights generally or in the future.

Even when any time in future, the application and binding of these terms on any user ceases to be applicable to a user due to any reason whatsoever, like, leaving the account, or the account being disabled or cancelled due to any reason by the user or by Multiversity of Success; certain sections of the terms regarding the following will still continue to govern any such relation between Multiversity of Success and any such person. These sections are; “Course Enrollment and Lifetime Access”, “MS Rights to Content Posted by any user”, “Using MS at one’s Own Risk’, “MS Rights”, “Miscellaneous Legal Terms’, and “Dispute Resolution”.

10.2 Disclaimers:

It may happen that the MS platform is down, either for planned maintenance or because something goes down with the site.

It may happen that one of the instructors or vendor or service provider is making misleading statements in their course.

It may also happen that we encounter security issues.

These are just possibilities of unforeseen events.

The user accepts that he/she will not have any recourse against MS in any of these types of cases; that are beyond any human control and so beyond control of the Multiversity of Success; and where due to such unforeseen situations, things don’t work out right.

In a more complete language, all the online services of Multiversity of Success are provided on an “as is” and “as available” basis. Multiversity of Success as well as its affiliates, suppliers, partners, and agents make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the course material, course content, any other services or their content, and expressly disclaim any warranties or conditions both express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

The Multiversity of Success and its affiliates, suppliers, partners, and agents make no warranty that the seekers, buyers or service receivers will obtain any specific results from use of the services. The use of the services provided by Multiversity of Success including any lessons or course content is entirely at the own risk of the user. Some jurisdictions don’t allow the exclusion of implied warranties, so some of the above exclusions may not apply to these users.

MS may decide to cease or make available certain features of the services at any time and for any reason. Under no circumstances will MS or its affiliates, suppliers, partners or agents be held liable for any damages due to such interruptions or lack of availability of such features.

MS is not responsible for delay or failure of our performance of any of the services when such a delay is caused by events beyond the reasonable control of any person working for or working on behalf of Multiversity of Success, like war, hostility, or sabotage; natural disaster; accident, sudden health challenges faced by any person providing any service or training, any sudden unplanned electrical, internet, or tele-communication outage; or any government restrictions.

10. Limitation of Liability:

There are risks inherent to using any online services like the ones you get here, for example, if any person enrolls in a health and wellness course like yoga, or seeks online service of any vastu, counseling or health support, or purchases any vastu, Feng Shui, yoga, health support instrument or gadget and ends up in injuring himself or herself due to any reason whatsoever. Such a seeker of course or service or buyer of any such product, is deemed to have fully accepted the responsibility these risks and is deemed to have agreed that he/she will have no recourse to seek damages against even if such a person suffers loss or damage from using any of the MS platform, products or services.

In more complete language, to the extent permitted by law, MS and its associate groups and companies, suppliers, partners, trainers, service providers and agents will not be liable for any indirect, incidental, punitive, or consequential damages including loss of data, revenue, profits, or business opportunities, or personal injury or death, whether arising in contract, warranty, tort, product liability, or otherwise, and even if the Multiversity of Success or its associates have been advised of the possibility of damages in advance.

The liability of Multiversity of Success and the liability of each of the group companies affiliated with Multiversity of Success, suppliers, partners, and agents; the trainers, service providers and vendors etc. that are affiliated with Multiversity of Success in; to the users of all the three types mentioned above, i.e. the students, the service receivers and the buyers; or to any third parties under any lawfully acceptable circumstance; is limited to one thousand Indian Rupees;1000/-INR or the amount any such person has paid Multiversity of Success in three month before the event giving rise to any claims takes place.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, but since as far as Multiversity of Success is concerned, the Jurisdiction of the Country of India is solely authorized govern these limitations; users from outside India have no right to say that some of the above may not apply to such users.

10.4 Indemnification:

If anyone, any of the Multiversity of Success student, buyer, service receiver or anyone into any indirect relationship with Multiversity of Success behaves in a way that gets Multiversity of Success in legal trouble, MS has every right to exercise legal recourse against such a person. So, anyone who directly or indirectly connects with Multiversity of success, agrees to indemnify, defend if MS so requests, and hold MS, the entire MS group companies, and their officers, directors, suppliers, partners, and agents from as harmless against any third-party claims, demands, losses, damages, or expenses including reasonable attorney fees; arising from (a) the content any post or submit by any such person, (b) any type of use of the services by any such person (c) any violation of these Terms by any such person, or (d) any violation of any rights of a third party by any such person. This indemnification obligation will survive the termination of these Terms and the use of services provided by MS.

10.5 Governing Law and Jurisdiction:

When these Terms mention “Multiversity of Success,” of “MS” they are taken to be referring to the Multiversity of Success (MS) entity that the user is contracting with. If the user is a student, service receiver or buyer, the contracting entity and governing law that governs him/her, will generally be determined based on his/her location.

If any trainer, student, service provider, service receiver, buyer or seller is contracting with Multiversity of Success that is a proprietary concern from India, these Terms are governed by the laws of India, without reference to its choice or conflicts of law principles and consent to the exclusive jurisdiction and venue of the courts in Mumbai, India.

If a student, trainer, service provider or service receiver, buyer or seller is located in a geographical region other than India, or if such a person accessing the services of Multiversity of success as a trainer, student, service receiver, service provider, seller or buyer and for the same one is contracting with MS, then, these Terms are governed by the laws of the State of India, without reference to its choice or conflicts of law principles. In cases where the “Dispute Resolution” section below doesn’t apply to you, you consent to the exclusive jurisdiction and venue of federal and state courts in Mumbai, Maharashtra India.

10.6 Legal Actions and Notices:

No action, regardless of form, arising out of or relating to this Agreement may be brought by either party more than three months after the cause of action has accrued, except in cases and situations, where this limitation cannot be imposed by law.

Any notice or other communication to be given hereunder will be in writing and given by registered or certified mail return receipt requested to the registered office address of Multiversity of Success and/or the residential address mentioned by the user with whom Multiversity of Success wishes to communicate, or by email to or from Multiversity of Success to or from the email associated with the user’s account with the official mail id of Multiversity of success; ms@multiversityofsuccess.in.

10.7 Relationship between MS and User:

Both the Multiversity of Success and its users agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us when you create and use any account of any type on the site of Multiversity of Success.

10.8 No Assignment:

The user has no right or authority to assign or transfer these Terms or any of the rights and licenses granted under them to anyone whatsoever. For example, if any account holder has registered an account with his/her name as an employee of some company, after that person leaves that company, that account cannot be transferred to any another employee of the same company who takes over in the position of that particular employee. Yet, MS has a right & authority to assign these terms or the rights and licenses granted under them to another company or person without restriction if approached through proper channel.

Nothing in these Terms confers any right, benefit, or remedy on any third-party person or entity. Every user agrees that his/her account is non-transferable and that all rights to his/her account and other rights under these Terms terminate upon his/her death.

11. Dispute Resolution:

Dispute is any situation where the two parties do not agree with the same outcome. This type of situation may happen between a trainer and student or between service provider and service receiver or between a vendor and buyer or between MS and any user.

If the MS support team resolve such a dispute by handling the situation and addressing the problem, it is great, but if such way out does not happen, we need to resort to the following ways to handle such situations:

In case if any disputes arise, and if we are unable to resolve it in satisfactory manner, and if the parties need to seek external help to resolve such a dispute, by agreeing to these terms, the parties agree to dissolve any such disputes with MS through binding arbitration that is applicable in the country of India (with very limited exceptions, not in court), and you waive certain rights to participate in class actions, as detailed in the Dispute Resolution section.

If there’s a dispute, the MS Support Team is happy to help resolve the issue. If that doesn’t work and the aggrieved party lives in the India or any other country, they have an option to go to small claims court or bring a claim in binding arbitration; in the country of India, where the Multiversity of Success is situated, as Multiversity of Success is governed by the laws of India. The parties cannot bring that claim in another court or participate in a non-individual class action claim against MS.

This Dispute Resolution section applies only if disputing parties live in India. Since most disputes can be resolved, so before bringing a formal legal case, we urge the parties to first try contacting our Support Team.

11.1 Small Claims:

Either of the two parties to any contract can bring any valid claim in small causes court in Mumbai, Maharashtra, India, as long as it qualifies to be brought in that court.

11.2 Going to Arbitration:

If the support system of MS is unable to resolve any dispute amicably, the complainant and and MS agree to resolve any claims related to these terms or other legal terms through final and binding arbitration, regardless of the type of claim or legal theory. If one of the parties brings a claim in court that should be arbitrated and the other party refuses to arbitrate it, the other party can ask a court to force both to go to arbitration i.e. to compel arbitration. In such situation, either party may ask court to halt proceeding as arbitration proceeding is on.

11.3 The Arbitration Process:

Any disputes that involve a claim of less than 10,000 INR must be resolved exclusively through binding non-appearance-based arbitration. A party electing arbitration must initiate proceedings by filing an arbitration demand with the MUMBAI CENTRE FOR INTERNATIONAL ARBITRATION (MCIA). The arbitration proceedings shall be governed by the MCIA Commercial Arbitration Rules, Consumer Due Process Protocol, and Supplementary Procedures for Resolution of Consumer-Related Disputes.

Both parties agree that the following rules will apply to the proceedings: (a) the arbitration will be conducted by telephone, online, or based solely on written submissions; at the choice of party seeking relief; (b) the arbitration must not involve any personal appearance by the parties or witnesses, unless both parties agree otherwise; and (c) any judgment on the arbitrator’s rendered award may be entered in any court with competent jurisdiction.

Disputes that involve a claim of more than 10,000 INR must be resolved per the MCIA’s rules about whether the arbitration hearing has to be in-person or not.

11.4 No Class Actions:

Both parties to any possible dispute will agree that each one can only bring claims against the other on an individual basis.

This means: (a) neither of the parties can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative action; (b) an arbitrator can’t combine multiple people’s claims into a single case, or preside over any consolidated, class, or representative action; and (c) an arbitrator’s decision or award in one person’s case can only impact that particular user and not any other users, and can’t be used to decide other users’ disputes as a precedent.

If at any time, any court decides that this “No class actions” clause isn’t enforceable or valid, then this “Dispute Resolution” section will be null and void, but the rest of the Terms will still apply.

11.5 Changes:

Notwithstanding the “Updating these Terms” section below, if MS changes this “Dispute Resolution” section after the date any party had last indicated acceptance to these Terms, such parties may reject any such change by providing MS written notice of such rejection by mail or hand delivery to Multiversity of Success addressed as: Attn: Multiversity of Success; 15/6, Brijwasi Vikas, Behind Sion Bus Depot, Sion west, Mumbai, Maharashtra 400022 or by email from the email address associated with the officially registered account of the user, to ms@multiversityofsuccess.in, within 30 days of the date such change became effective, as indicated by the “last updated on” language above.

To be effective, the notice must include the full name of the party and must clearly indicate the intent of a party to reject changes to this “Dispute Resolution” section with valid reasons.

By rejecting such changes, the rejecting party agrees that he/she will arbitrate any dispute between him/her and MS in accordance with the provisions of this “Dispute Resolution” section as of the date he/she last indicated acceptance to these Terms.

12. Updating These Terms:

From time to time, MS may update the terms to clarify the practices of MS or to reflect new or different practices, especially when new feature is added or any feature is disabled.

MS reserves the right in its sole discretion to modify and/or make changes to these terms at any time. If MS makes any material change, MS will notify all the users using prominent means, such as by email notice sent to the email address specified in the account of each user or by posting a notice through the services of MS. All such Modifications will become effective on the day they are posted unless stated otherwise.

The continued use of any user of the MS Services after such changes become effective shall mean that the user has accepted those changes. Any revised Terms shall supersede all previous Terms.

13. How to Contact Us:

Any user who is using MS platform in any authority whatsoever, has every right to get in touch with MS and to contact the support team of MS. For this such a person may use our official mail id; ms@multiversityofsuccess.in and communicate with us using the email id with which such a user has registered his/ her account with MS.

The support team of Multiversity of Success will certainly answer and also resolve all the questions, concerns of such users at the earliest.
